Moorean arguments are a popular and powerful way to engage highly revisionary philosophical views, such as nihilism about motion, time, truth, consciousness, causation, and various kinds of skepticism (e.g., external world, other minds, inductive, global). They take, as a premise, a highly plausible first-order claim (e.g., cars move, I ate breakfast before lunch, it’s true that some fish have gills) and conclude from it the falsity of the highly revisionary philosophical thesis. Moorean arguments can be used against nihilists in ethics (...) (error theorists), too. Recently, error theorists have recognized Moorean arguments as a powerful challenge and have tried to meet it. They’ve argued that moral Moorean premises seem highly credible to us, but aren’t, by offering various debunking explanations. These explanations all appeal to higher-order evidence—evidence of error in our reasoning. I argue that drawing attention to higher-order evidence is a welcome contribution from error theorists, but that the higher-order evidence actually counts further against error theoretic arguments—including their debunking explanations—and further in favor of Moorean arguments and the commonsense views they support. Along the way I answer a few prominent objections to Moorean arguments: that they are objectionably question-begging, rely on categorizing some facts as “Moorean Facts”, and that reports of one’s credence in a proposition bears no interesting relation to that proposition’s credibility. One of the deepest and longest-lasting debates in ethics concerns a version of the Euthyphro question: are choiceworthy things choiceworthy because agents have certain attitudes toward them or are they choiceworthy independent of any agents’ attitudes? Reasons internalists, such as Bernard Williams, Michael Smith, Mark Schroeder, Sharon Street, Kate Manne, Julia Markovits, and David Sobel answer in the first way. They think that all of an agent’s normative reasons for action are grounded in facts about that agent’s pro-attitudes (e.g., her (...) desires, valuing states, normative judgments). According to the most popular brand of internalism, idealizing internalism, an agent’s reasons are grounded, not in her actual pro-attitudes, but rather in what her pro-attitudes would be in suitably idealized conditions. Idealizing internalists presuppose that, for any agent with an irrational set of attitudes, there is one uniquely rational set that that agent would have if she were to undergo the relevant idealizing process. I argue that this assumption is false and that it raises two puzzles for idealizing internalism: one about the existence of practical reasons and another about their normative weight. I argue that idealizing internalists have an adequate solution to the first puzzle but not the second. Indeed, when they try to solve the second puzzle, they confront a dilemma. This second puzzle and the associated dilemma thus constitutes a powerful, but so far unnoticed, difficulty for idealizing internalism. (shrink)

People sometimes knowingly undermine the achievement of their own goals by, e.g., playing the lottery or borrowing from loan sharks. Are these agents acting irrationally? The standard answer is “yes.” But, in a recent award-winning paper, Jennifer Morton argues “no.” On her view, the norms of practical reasoning an agent ought to follow depend on that agent’s resource context (roughly, how rich or poor they are). If Morton is correct, the orthodox view that the same norms of practical rationality apply (...) to all agents needs revision. I argue that Morton’s arguments fail on empirical and philosophical grounds. What’s at stake? If Morton is correct, poverty relief agencies ought to re-design their incentives so resource-scarce agents can rationally respond to them. If I’m correct, resource-scarce agents do act irrationally in the cases under discussion, and we shouldn’t be shy about saying so. Instead of declaring them rational, we should try to understand the causes of their irrational behavior and help them better succeed by their own lights. (shrink)

Arguments from disagreement against moral realism begin by calling attention to widespread, fundamental moral disagreement among a certain group of people. Then, some skeptical or anti-realist-friendly conclusion is drawn. Chapter 2 proposes that arguments from disagreement share a structure that makes them vulnerable to a single, powerful objection: they self-undermine. For each formulation of the argument from disagreement, at least one of its premises casts doubt either on itself or on one of the other premises. On reflection, this shouldn’t be (...) surprising. These arguments are intended to support very strong metaphysical or epistemological conclusions about morality. They must therefore employ very strong metaphysical or epistemological premises. But, given the pervasiveness of disagreement in philosophy, especially about metaphysics and epistemology, very strong premises are virtually certain to be the subject of widespread, intractable disagreement—precisely the sort of disagreement that proponents of these arguments think undermine moral claims. Thus, these arguments undermine their own premises. If Chapter 2’s argument is sound, it provides realists with a single, unified strategy for responding to any existing or forthcoming arguments from disagreement. (shrink)

We often say that one reason is stronger, or weightier, than another. These are metaphors. What does normative strength or weight really consist in? Scanlon (2014) offers a novel answer to this question. His answer appeals to counterfactuals of various kinds. I argue that appealing to counterfactuals leads to deep problems for his view.

In his recent article entitled ‘Can We Believe the Error Theory?’ Bart Streumer argues that it is impossible (for anyone, anywhere) to believe the error theory. This might sound like a problem for the error theory, but Streumer argues that it is not. He argues that the un-believability of the error theory offers a way for error theorists to respond to several objections commonly made against the view. In this paper, we respond to Streumer’s arguments. In particular, in sections 2-4, (...) we offer several objections to Streumer’s argument for the claim that we cannot believe the error theory. In section 5, we argue that even if Streumer establishes that we cannot believe the error theory, this conclusion is not as helpful for error theorists as he takes it to be. (shrink)

We provide a novel defense of the possibility of level-splitting beliefs and use this defense to show that the steadfast response to peer disagreement is not, as it is often claimed to be, unnecessarily dogmatic. To provide this defense, a neglected form of moral disagreement is analysed. Within the context of this particular kind of moral disagreement, a similarly neglected form of level-splitting belief is identified and then defended from critics of the rationality of level-splitting beliefs. This paper investigates Jesus’ Principles of Breaking Barriers: A Reflection on John 4:3-42 as a pivot and principle for breaking barriers from biblical perspective. Worthy of note is the fact that there existed socio-ethnic barrier between the Jews and Samaria; gender barrier imposed by Jesus’ androcentric culture and a moral barrier imposed by the Samaritan woman’s assumed behaviour. This paper using hermeneutical theory of biblical interpretation and historical insight into this Johannine text brings to the fore that, the Jewish-Samaritan barrier (...) had ethnic, religious and political undertones which made the Samaritans and Jews to see themselves as ‘enemies’; the interaction with the Samaritan woman broke barriers and set a new agenda for relationship with ‘inferior’ gender and morally low in the human society. Herein exists principles of breaking barriers set by Jesus which are worthy of emulation in the twenty-first century which is plagued by socio-ethnic, religious, gender and moral barriers. (shrink)

In his recent book Error Theory: History, Critique, Defence, Jonas Olson attempts to revive the argument from queerness originally made famous by J.L. Mackie. In this paper, we do three things. First, we eliminate four untenable formulations of the argument. Second, we argue that the most plausible formulation is one that depends crucially upon considerations of parsimony. Finally, we evaluate this formulation of the argument. We conclude that it is unproblematic for proponents of moral non-naturalism—the target of the argument from (...) queerness. (shrink)

From a modernist perspective, it may be difficult to ascribe graphics to any form of traditional African art. This could be due to the embrace of western values by Africans, and of modernity on the one hand, and the overwhelming negative influence of westernization on the diverse African cultural practices, on the other hand. However, many elements of the traditional art forms are imbued with icons and symbols which expressions may be viewed as graphical in nature. This paper looks into (...) the dynamics of graphics in the art of the traditional Ibibio society of Nigeria and attempts to appraise form and content. It is aimed at investigating the various symbolic applications in Ibibio traditional art forms and to establish the degree of graphics inter face with these art forms. The paper expounds the term graphics, identifies, and relates it to, salient properties of graphics in the art products of the traditional Ibibio society. It also examines the manner in which societal norms and social institutions are fundamental to the art forms proportionate to the communicative indices. The methodology for this study includes in situ study, formalism, iconographic studies and library research. The paper concludes that graphics is a crucial index in the arts of the traditional Ibibio society of Nigeria and, indeed, Africa. (shrink)

Conceptualism is the view that at least some perceptual representation is conceptual. This paper considers a prominent recent argument against Conceptualism due to Ned Block. Block’s argument appeals to patterns of color representation in infants, alleging that infants exhibit categorical perception of color while failing to deploy concepts of color categories. Accordingly, the perceptual representation of color categories in infancy must be non-conceptual. This argument is distinctive insofar as it threatens not only the view that all perception is conceptual, but (...) also views that restrict the Conceptualist thesis to perceptual categorization. However, I contend that it fails at two stages. Block’s arguments for the perceptual representation of color categories in infancy, and against color concept deployment in infancy, are unpersuasive. Thus, Block has not vanquished Conceptualism. I draw out implications for debates about the perception-cognition border and for the question of whether explicit categorization occurs in perception. End-of-life care has a number of characteristics that make economic evaluation particularly challenging. These include proximity to death, the improbability of survival gain, individuals’ changing priorities, declining cognition and effects on close persons. In view of these particularities of end-of-life care, some researchers have determined that current ‘extra-welfarist’ approaches to defining do not adequately reflect well-being. As a result, suggestions are being made that would see the QALY approach either replaced or subject to significant redefinition. The purported goal of adopting (...) alternative evaluation approaches is to extend the evaluative space ‘beyond’. The Repugnant Conclusion served an important purpose in catalyzing and inspiring the pioneering stage of population ethics research. We believe, however, that the Repugnant Conclusion now receives too much focus. Avoiding the Repugnant Conclusion should no longer be the central goal driving population ethics research, despite its importance to the fundamental accomplishments of the existing literature.

A minimal truthmaker for a given proposition is the smallest portion of reality which makes this proposition true. Minimal truthmakers are frequently mentioned in the literature, but there has been no systematic account of what they are or of their importance. In this article we shall clarify the notion of a minimal truthmaker and argue that there is reason to think that at least some propositions have minimal truthmakers. We shall then argue that the notion can play a useful role (...) in truthmaker theory, by helping to explain the truth of certain propositions as precisely as possible. (shrink)

The aim of this paper is to provide a conceptual framework that will help in understanding and evaluating, along social and ethical lines, the issue of killing day-old male chicks and two alternative directions of responsible innovations to solve this issue. The following research questions are addressed: Why is the killing of day-old chicks morally problematic? Are the proposed alternatives morally sound? To what extent do the alternatives lead to responsible innovation? The conceptual framework demonstrates clearly that there is a (...) moral “lock-in”, and why the killing of day-old chicks is indeed an issue. Furthermore, it is shown that both alternative directions address some important objections with regard to the killing of day-old chicks, but that they also raise new dilemmas. It also becomes clear that the framework enables and secures anticipation, reflection, deliberation with and responsiveness to stakeholders, the four dimensions of responsible innovation, in a structured way. The objective of this paper is to study algebraic properties of neutrosophic matrices, where a necessary and sufficient condition for the invertibility of a square neutrosophic matrix is presented by defining the neutrosophic determinant. On the other hand, this work introduces the concept of neutrosophic Eigen values and vectors with an easy algorithm to compute them. Also, this article finds a necessary and sufficient condition for the diagonalization of a neutrosophic matrix.

The main objective of this project is to provide acoustic assistance to the blind people and also deal with the problems faced by them to walk like the normal human beings. Thus the project aims to develop a device that would serve as a guiding assistance to them. The paper focuses on designing a device for visual impaired (or blind) people that would help them to travel independently and also with more ease. One of the biggest problem that the visual (...) impaired ones face is while travelling because when they walk in the indoors and outdoors they are not well aware of information about their location and orientation with respect to traffic and obstacles on their way unlike the normal beings. The technology proposed in the paper serves as a solution for visual impaired people. The project consists of smart shoe and smart cane (stick) that alerts visually impaired people over obstacles coming between their ways and could help them in walking with less collision. The main objective of this paper is to address a reliable encompassing of a call and a shoe that could communicate with the user through voice alert and pre-coded messages. (shrink)

Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. In this paper we propose a very general de nition of combination of logics by means of the concept of sheaves of logics. We first discuss some properties of this general definition and list some problems, as well as connections to related work. As applications of our abstract setting, we show that the notion of possible-translations semantics, introduced in previous papers by the first author, can be described in categorial terms. Possible-translations semantics constitute illustrative cases, since they provide a new (...) semantical account for abstract logical systems, particularly for many-valued and paraconsistent logics. Resumo: A crise na União Europeia e os programas de austeridade subsequentes fizeram emergir uma miríade de movimentos sociais, diversos na sua natureza e nos seus propósitos. O que se pretende aferir neste artigo é a relação e a conexão existentes entre o Estado, o poder económico, a sociedade civil e os movimentos sociais neste contexto específico de crise. Procuraremos, nesta breve abordagem, explanar alguns elementos de originalidade intrínsecos aos movimentos sociais hodiernos, patentes na sua forma de participação e organização, (...) assim como aplicar estas questões teóricas relevantes ao contexto português. A parte empírica, dada a escassez de estudos de caso existentes, será apoiada no último inquérito do European Social Survey, de 2012. Analisando um conjunto de perguntas aí explícitas, podemos compreender, de forma indirecta, algumas das dinâmicas que caracterizam estes movimentos. Abstract: The crisis in the European Union and the subsequent austerity programs have unleashed a myriad of social movements, diverse in its nature and purpose. The purpose of this paper is to assess the relationship and connection between the State, economic power, civil society and social movements in this specific context of crisis. We will try, in this brief approach, to explain some elements of originality intrinsic to modern social movements, evident in their form of participation and organization, as well as to apply these theoretical questions relevant to the Portuguese context. The empirical part, given the paucity of existing case studies, will be supported in the last survey of the European Social Survey of 2012. By analyzing a set of questions explicit there, we can, indirectly, understand some of the dynamics that characterize these movements. (shrink)

This chapter discusses the Ganser syndrome and gives a brief account on its clinical features. A significant number of clinicians in Europe continued accepting Ganser's basic postulates that the patients showed significant memory disorder and 'answers towards the question' within the framework of traumatic or reactive hysteria. In elderly patients, Ganser type symptoms may be indicative of the onset of dementia. Ganser syndrome raises the question of the interaction between concepts, ideology and clinical observation. The clinician must be aware that (...) a misdiagnosed case of Ganser-type hysteria may result in lawsuits, unnecessary surgical interventions, inappropriate use of minor and major tranquillizers, and social consequences that may be destabilizing for the patient and family. Positive results in the organic investigation should lead to a firm diagnosis and disconfirmation of Ganser syndrome. Persistent negative results and dramatic improvement should tend to confirm the diagnosis. (shrink)

De uma perspectiva comportamentalista radical, o eu é um repertório verbal complexo, que, como tal, tem uma gênese social. O reconhecimento da origem social do “eu” abre caminho para uma análise política, incluindo uma discussão do pa- pel das relações de poder na constituição do eu. Entretanto, uma concepção radicalmente social do “eu”, como a proposta pelo comportamentalismo, suscita um problema político: se o eu é integralmente produto do ambiente social, de onde viria uma eventual “vontade” de romper com esse (...) sistema? Parece que para reconhecer a possibilidade de ação política transformadora seria preciso preservar uma noção descontextualizada de “eu”. Considerando essa dificuldade, o objetivo deste artigo é propor uma interpretação política da constituição do “eu” no âmbito do comportamentalismo radical, mantendo no horizonte a possibilidade de uma ação política transformadora. Para tanto, destacamos como “eus” oprimidos são tornados submissos, mas também como de certas contingências podem emergir “eus” subversivos, que se opõem a um sistema social opressivo. Esse “eu” subversivo é caracterizado por um repertório de autoconhecimento mais amplo, que inclui a discriminação do papel das relações de poder e do controle promovido por instituições. Concluímos, com isso, que um “eu” socialmente constituído pode ser politicamente ativo. (shrink)

A pecuária brasileira tem destaque acentuado quanto a sua participação no produto interno Bruto nacional (PIB), entretanto, dentro da cadeia produtiva das proteínas de origem animal, a ovinocultura ainda se apresenta como uma atividade com pouca expressividade e tecnificação frente a outras espécies animais domésticas, desta forma seu fomento e próspero desenvolvimento é dependente de inúmeros fatores, sendo que destes o correto manejo reprodutivo de espécies , a escolha de raças autóctones ou do exterior com boa adaptabilidade para serem criadas (...) em regiões de clima tropical e subtropical encontrados no Brasil e a correta seleção quanto a características reprodutivas de matrizes e principalmente de jovens carneiros cujos quais se deseja utilizar como reprodutores em rebanhos que buscam a constante evolução produtiva se faz muito importante. Tal cenário traz à tona a importância da realização de estudos referentes a suplementação de elementos como vitaminas e microminerais, que embora não sejam os maiores constituintes das dietas ofertadas aos animais de interesse zootécnico, exercem grande influência não só no crescimento e desenvolvimento do tecido muscular como também podem estar positivamente correlacionados quanto aos aspectos reprodutivos . O presente trabalho objetivou a avaliação da qualidade seminal e morfometria testicular de carneiros púberes submetidos a suplementação injetável de minerais e vitaminas, sendo utilizados 30 reprodutores divididos em três grupos de dez animais cada, com delineamento dos grupos inteiramente casualizado. Ao primeiro grupo foi administrada suplementação vitamínica e mineral (Grupo VM), no segundo grupo houve apenas suplementação vitamínica (Grupo VIT) e no terceiro grupo a suplementação mineral (Grupo MIN). No presente trabalho buscou-se avaliar os efeitos da aplicação de complexo vitamínico e mineral sobre a qualidade do sêmen ovino, medidas morfométricas testiculares e alteração nas concentrações dos hormônios cortisol e testosterona. Palavras chave: elementos-traço, hormônios, nutracêutico, ovinos, sêmen -/- Brazilian livestock has a strong emphasis in terms of its participation in the Gross National Product (GDP), however, within the production chain of animal proteins, sheep farming still presents itself as an activity with little expressiveness and technology compared to other domestic animal species. in this way its promotion and development depends on the correct methods, which are the reproductive of sheep species, the choice of indigenous or foreign breeds with good adaptability to be created in tropical and subtropical regions found in Brazil and the correct selection of selected animals and selection of products that are very important for the demand for products of constant breeding. This scenario leads to the development of important studies for the supplementation of such vitamins and trace minerals, which, although not the largest components of diets, exert a great influence not only on the growth of muscle tissues but can also be positively correlated with their reproductive aspects. The present evaluation of seminal quality and testicular morphometric of pubertal animals includes an injectable supplement of vitamins and minerals, using 30 sires distributed in three groups of animals each, with a completely random design of the products. The first supplementary group was given the mineral supplement (VM Group) in the second group only vitamin supplementation (VM Group) and the mineral supplementation group (MIN Group). La educación es siempre, por su misma naturaleza, transformadora. Transforma vidas, transforma realidades, transforma culturas y civilizaciones y todo ello a partir del hecho básico inicial de que dicha transformación comienza por ser la de sus propios actores: educadores y educandos. Es válida, en relación con ello, la afirmación del filósofo Gadamer (2000) acerca de que “educar es educarse”, pues en la educación “de lo que se trata –dice el autor, parafraseando a Hegel-- es de que el hombre acceda él (...) mismo a su morada”: acceder a la morada en el mundo es para la persona abrir el camino a ese espacio en el que se siente bien, donde es feliz. Desde esta perspectiva, el ejercicio de educarse es, para educadores y estudiantes en primer término pero con proyección a la sociedad entera, un ejercicio compartido de diálogo, involucramiento y enriquecimiento mutuo mediante el cual asumen el desafío de impulsar sus vidas hacia la plenitud personal, en armonía con la construcción de felicidad social. En tiempos en los que predominan formas de educación orientadas al éxito, a ser competitivo y poseer habilidades avanzadas para interactuar con las máquinas, o bien –en algunas perspectivas psicológicas-- solamente para adaptarse y no sufrir, según Gadamer (2000) “si lo que uno quiere es educarse y formarse, es de fuerzas humanas de lo que se trata y sólo si lo conseguimos sobreviviremos indemnes a la tecnología y al ser de la máquina” (p. 48) o, agregaríamos, a la ilusión de refugiarnos en islas de bienestar individual que nos aíslan de la comunidad y del entorno. Esas fuerzas humanas de las que habla el filósofo son las que pueden impulsar una educación basada en la capacidad de aprender a ser felices a lo largo de toda la vida. (shrink)

Se estudia, con fines académicos, el proceso penal de única instancia o de jurisdicción privilegiada, ante la Suprema Corte de Justicia (SCJ) de República Dominicana, previsto en el artículo 154.1 de la Constitución dominicana de forma expresa con el objetivo de asegurar el funcionamiento de altos cargos del Estado siendo sujetos procesales pasivos aquellos funcionarios públicos investidos de inmunidad o fuero procesal. Para que la SCJ tenga competencia judicial inobjetable y pueda juzgar válidamente, en única instancia, a personas particulares sin (...) dicha prerrogativa procesal, por arrastre o por conexidad de la causa, tiene que estar autorizada expresamente por la ley procesal penal dominicana (que no es el caso) sin que le valga invocar la jurisprudencia interna porque contradice el derecho convencional y desconoce decisiones vinculantes -cosa interpretada de la Corte Interamericana de DDHH. There is a curious phenomenon where people from marginalized populations are taken to be arrogant when they show no signs of superiority. In effect, their actions are misconstrued, and their attitudes are rendered unintelligible. Given that arrogance is standardly taken to be a flaw in one’s moral character, understanding such misattributions should give us insight into the affective marginalization many people face. This talk aims to give a thorough exploration of arrogance under oppression. I argue that arrogance is a kind (...) of self-preoccupation that involves projecting one’s values, goals, and concerns onto others as if they were objective values, goals, and concerns. When the affectively marginalized communicate their self-respect through things like protest, people mistake that self-respect as self-preoccupation given how the affectively marginalized are constructed. Furthermore, given how affective marginalization not only inhibits how the marginalized are understood by others, but inhibits their own affective lives, I argue that taking up an arrogant attitude is not always morally vicious, but can be a beautiful form of political resistance but all things considered good. En la presente reflexión, se exponen algunos de los efectos jurídicos y procesales derivados de la Declaración Conjunta de Argyle por el Diálogo y la Paz entre Guyana y Venezuela (Declaración Conjunta, en adelante), publicada en San Vicente y Las Granadinas en fecha 14 de diciembre de 2023. Se analizan, de manera sucinta, las implicaciones procesales que la Declaración Conjunta, asumida como elemento material probatorio, genera a favor de la posición jurídica de Venezuela que puede promover, con base a una (...) serie de hechos nuevos de relevante valor y eficacia procesal, tanto la i) la excepción de inadmisibilidad sobrevenida de la demanda judicial que, por el territorio de la Guayana Esequiba, promueve Guyana contra Venezuela, en la Corte Internacional de Justicia (CIJ) dada la impprocedencia de la misma y ii) la excepción de incompetencia sobrevenida de la CIJ para tramitar y decidir el litigio... Los autores dejan enunciado que, conforme a los Principios Generales del Derecho Internacional, concordados al artículo 52 de la Convención de Viena sobre Derecho de los Tratados y con la Declaración Conjunta de Argyle, es jurídicamente factible que Venezuela, conforme a los Principios el procedimiento de los artículos 65 y 66 ejusdem, promueva la nulidad absoluta retroactiva del Tratado Arbitral de Washington de 1897 y, de manera consecuencial, la nulidad absoluta retroactiva, ya reconocida, del Laudo Arbitral de París de 1899 por la coacción y la agresión y la invasión territorial que sirvieron de contexto y pretexto para su aprobación por parte de Venezuela, como medio para tratar de darle aparente legalidad a la ocupación militar ilegal de nuestro territorio Esequibo por parte del Reino Unido. When we perceive an object, we perceive the object from a perspective. As a consequence of the perspectival nature of perception, when we perceive, say, a circular coin from different angles, there is a respect in which the coin looks circular throughout, but also a respect in which the coin's appearance changes. More generally, perception of shape and size properties has both a constant aspect—an aspect that remains stable across changes in perspective—and a perspectival aspect—an aspect that changes depending on (...) one's perspective on the object. How should we account for the perspectival aspect of spatial perception? We present a framework within which to discuss the perspectival aspect of perception and put forward three desiderata that any account of the perspectival aspect of perception should satisfy. We discuss views on which the perspectival aspect of perception is analyzed in terms of constitutively mind-dependent appearance properties as well as views on which the perspectival aspect of perception is analyzed in terms of representations of mind-independent perspectival properties. Se responde, desde la dogmática de la Corte Constitucional colombiana, aduciendo los “criterios de identificación” normativa de los derechos fundamentales centrados en i) su relación de funcionalidad con el logro del contenido normativo de la dignidad humana, ii) su traducción como derechos subjetivos, iii) los “consensos dogmáticos, jurisprudenciales o de derecho internacional, legal y reglamentario sobre su fundamentalidad” y, iv) su exigibilidad -más que su propia justiciabilidad-, como presupuestos jurídicos, reconocimiento y aplicación pragmática constitucional en la esfera de vida de (...) la persona humana y la comunidad política, basados, también, en los pilares conceptuales del llamado Constitucionalismo Humanista. In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...) marginalization. In the latter part of the paper, I will discuss how my arguments bear on recent arguments by Robin Dembroff and Daniel Wodak (2018) on the use of gender-neutral language. They argue that we have a duty not to use gender-specific pronouns for anyone. Their conclusion turns, in part, on a rejection of gender affirmation as a moral duty. The value of gender affirmation, rooted in our moral perception of trans people, should make us skeptical of this conclusion, in favor of a more nuanced and pluralistic approach to the ethics of gendering. One’s constitution—whether one is generous or miserly, temperate or intemperate, kind or mean, etc.—is beyond one’s control in significant respects. Yet one’s constitution affects how one acts. And how one acts affects one’s moral standing. The counterintuitive inference—the so-called problem of constitutive moral luck—is that one’s moral standing is, to some significant extent, beyond one’s control. This article grants the premises but resists the inference. It argues that one’s constitution should have no net impact on one’s moral standing. While a (...) bad constitution lowers the chance that one will act morally, it offers significant gains to moral standing should that chance materialize. A good constitution increases one’s chance of performing good acts but for correspondingly more modest gains. This effect should smooth out, and possibly eliminate, the expected impact of constitution on moral standing. (shrink)

The ability to perceive the shapes of things as enduring through changes in how they stimulate our sense organs is vital to our sense of stability in the world. But what sort of capacity is shape constancy, and how is it reflected in perceptual experience? This paper defends a pluralist account of shape constancy: There are multiple kinds of shape constancy centered on geometrical properties at various levels of abstraction, and properties at these various levels feature in the content of (...) perceptual experience, governing patterns of apparent shape similarity. I propose that the varieties of shape constancy are subserved by the syntactic complexity of perceptual shape representations. By assigning discrete constituents to various abstract shape parameters, these representations attune us to the preservation of certain abstract shape properties through changes in more determinate shape properties. Finally, I draw broader lessons concerning the nature and function of perceptual constancy. (shrink)

Este ensaio estabelece uma comparação estética e fenomenológica entre os pensamentos de Yves-Klein e Merleau-Ponty. Se o pintor materializou as suas reflexões e concepções em obra pictórica, o fenomenólogo francês dissertou na escrita filosófica o resultado da sua reflexão. Da análise conjunta entre um e outro resulta esta fenomenologia e estética comparativa que apresenta alguns conceitos fundamentais que alimentaram essas reflexões, tais como a visibilidade, o corpo, o mundo. Yves Klein -/- Abstract:This essay establishes an aesthetic and phenomenological comparison between the thoughts of Yves-Klein and Merleau-Ponty. If the painter materialized his reflections and concepts in pictorial work, the French phenomenologist disserted in the philosophical writing the result of his reflection. From the joint analysis between one and the other, this phenomenology and comparative aesthetics results, which presents some fundamental concepts that fed these reflections such as visibility, the body, the world.
